The inherent dignity of mankind (Surah Al-Isrā', 17:70) and the safeguarding of private life (Surah An-Nūr, 24:27) condemn any violation of these divine endowments. 'Honor violation' (sexual assault), as a clear manifestation of 'obscenity' and 'reprehensible conduct' (Surah Al-`Ankabūt, 29:45), constitutes a blatant transgression against this sanctity, wherein an individual, through force, threat, or deception, violates the sexual integrity of another outside the framework of lawful marriage. This crime is not merely an individual harm but is considered 'corruption on earth' (Surah Al-Baqarah, 2:205), threatening the very foundations of the family and the health of society.
Based on Quranic teachings, defense against such aggression is not only a right but, in certain cases, a religious obligation. The verse "And do not argue for the deceitful" (Surah An-Nisā', 4:105), alongside the verses on legitimate self-defense (Surah Al-Baqarah, 2:190 & 191), emphasize the legitimacy of resisting oppressors. Relying on these foundations, Imami jurisprudence has derived the relevant rulings. In cases of full penetration (rape), given the severity of the obscenity, the decisive ruling of the Quran and Sunnah regarding the adulterer (Surah An-Nūr, 24:2), coupled with the principle of self-defense, justifies the punishment of the assailant and renders his blood forfeit. In cases of sexual assault falling short of penetration, based on the principles of removing 'hardship' and 'harm' (Surah Al-Ḥajj, 22:78) and the injunction to defend the oppressed, proportional defense up to the point of killing—if repelling the aggression by other means is impossible—is deemed permissible.
